1. Platform Status & Ongoing Development

OPTA is an educational platform that is actively under development and continuous improvement. Features, content, functionality, and availability may change at any time without notice. You acknowledge that:

  • The Platform may contain bugs, errors, or temporary interruptions.
  • Content may be updated, revised, or removed.
  • New features may be added or existing features modified.
  • Your continued use of the Platform constitutes acceptance of these changes.

2. Eligibility & Agreement to Use

You must be at least 18 years old (or the age of majority in your jurisdiction) to use OPTA. By using the Platform, you represent that you are legally capable of entering into a binding agreement.

3. Subscriptions, Access & Content Authenticity

OPTA provides high-fidelity preparatory materials for the NBEO® Part I exam.

  • Expert-Authored Content: All practice questions and explanations are authored and vetted by human experts to ensure accuracy for NBEO® standards.
  • AI Integrated Features: OPTA may use artificial intelligence to proofread educational question explanations and provide performance feedback. AI-generated content is educational and informational only; it may contain errors and should not be relied upon as medical, professional, or exam-score advice.
  • Free Trial: Limited access to select questions and basic analytics.
  • 3-Month "Sprint" Plan: $195.00 for full access to all questions, mock exams, and AI-driven feedback.
  • 6-Month "Comprehensive" Plan: $245.00 for full access to all questions, mock exams, and AI-driven feedback.
  • Terms of Access: Subscriptions are non-transferable, and login credentials may not be shared. OPTA reserves the right to modify pricing or features at any time.

4. Refund & Cancellation Policy

Because OPTA provides immediate access to digital content:

  • Refunds are generally not available.
  • A refund may be requested within 7 days of purchase only if no meaningful access or usage has occurred.
  • Payments processed through third-party providers are subject to their respective refund policies.
  • OPTA reserves sole discretion in refund determinations.

5. Educational Purpose & No Score Guarantee

OPTA is intended solely as a supplemental educational study tool for the NBEO®.

  • We do not guarantee exam scores, passing results, licensure, or academic outcomes.
  • Success depends on multiple factors beyond OPTA's control, including individual effort and exam conditions.
  • Any analytics, predictions, or AI performance indicators are informational only.

OPTA is not affiliated with, endorsed by, or partnered with the National Board of Examiners in Optometry (NBEO®).

6. Medical & Professional Disclaimer

OPTA is not a medical provider and does not offer medical advice, diagnosis, or treatment. Content is for educational purposes only and should not replace professional medical judgment or consultation with licensed healthcare providers.

7. Intellectual Property Rights

All content on OPTA—including but not limited to human-authored questions, explanations, analytics, software, and designs—is owned by or licensed to OPTA.

  • Copy, distribute, sell, or publicly display content.
  • "Mirror" content on any other server or "screen scrape" the Platform.
  • Reverse-engineer or use automation/bots to extract Platform Data.

8. User Responsibilities & Prohibited Conduct

You agree not to share account credentials, use automated tools (spiders/scraping), or attempt to disrupt the Platform's infrastructure. Violation may result in immediate termination without refund.

9. Community & Collaboration Features

If OPTA provides study rooms or collaborative tools:

  • You must remain respectful and professional.
  • You may not post copyrighted materials from other exam prep companies (e.g., KMK or OptoPrep).
  • By posting content, you grant OPTA a non-exclusive license to display it for educational purposes.

10. Limitation of Liability

To the maximum extent permitted by law, OPTA is provided "as is". OPTA and its developers shall not be liable for any indirect, incidental, or consequential damages. The total aggregate liability of OPTA for all claims shall not exceed the amount paid by you to the Platform during the six (6) months preceding the claim.

11. Indemnification & Termination

You agree to indemnify OPTA against claims arising from your misuse of the Platform or violation of these Terms. OPTA may suspend or terminate access at any time for such violations, with no refunds issued.

12. Governing Law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-law principles.

Privacy Policy

1. Information We Collect

We may collect account information (name, email, school, graduation year, NBEO® exam date), usage data (study progress and performance metrics), payment metadata, and technical data such as IP address, browser type, and device information.

2. How We Use Your Information

We use information to operate and personalize the Platform, provide study tools and subscriptions, communicate with you, and improve our services. Aggregated and anonymized data may be used for analytics and research.

3. AI Content

OPTA may use artificial intelligence to proofread educational question explanations and provide performance feedback. AI-generated content is educational and informational only; it may contain errors and should not be relied upon as medical, professional, or exam-score advice.

4. Service Providers, Disclosure & Security

We use Stripe for payment processing, Base44 for Platform hosting and infrastructure, and AI model providers including OpenAI, Google, and Anthropic to support AI features. These providers process information only as needed to provide their services. We do not sell personal information. We use reasonable safeguards, including HTTPS and restricted access controls, but no system is completely secure.

5. User-Uploaded Content & Storage

Profile pictures and Study Room images are stored using publicly accessible direct URLs so they can be displayed in the Platform. Do not upload sensitive personal, medical, financial, or confidential information. Removing a post or profile image removes its Platform reference; storage-provider deletion may take additional time.

6. Data Retention

We retain account and study data while your account remains active and until you request deletion. When you delete your account, we remove personal profile information and account-linked records; anonymized study analytics may be retained indefinitely without direct identifiers.

7. Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, or receive a portable copy of your personal information, and to opt out of the sale or sharing of personal information where applicable. OPTA does not sell personal information. You may use the account-deletion control in your profile or contact us through the Support form to make a privacy request.

8. Cookies & Tracking

We use essential cookies, local storage, and similar technologies to keep you signed in, remember preferences, and maintain Platform functionality. We may also collect limited usage and technical information to understand and improve the Platform.

9. International Transfers

Our service providers, including AI providers, may process information in countries other than your own. Where required, we use appropriate safeguards for these transfers.

10. Security Incidents

If we determine that a security incident has affected your personal information, we will provide notice as required by applicable law.
